1. About Fixyan and these Terms
Fixyan operates an online marketplace (mobile app and website) that connects customers ("you", "Customer") with independent home-service professionals ("Pros") in Armenia, beginning in Yerevan.
Fixyan is an information-technology intermediary (an information society service), not the provider of the services. We do not perform the cleaning, plumbing, electrical, handyman, A/C or other services booked through the platform, and we do not employ the Pros. Pros are independent businesses operating under civil-law contracts governed by the Civil Code of the Republic of Armenia. The contract for the services is between you and the Pro.
By creating an account or using Fixyan you agree to these Terms. If you do not agree, do not use the platform. Nothing in these Terms deprives you of the protection granted by mandatory provisions of Armenian consumer-protection legislation.
2. Eligibility
You must be at least 18 years old and able to enter into a binding contract. You agree to provide accurate account information and keep it up to date.
3. How booking works
- You select a service and provide details (e.g. size, schedule, address, and optionally a photo of the job).
- For some services the price shown is a guaranteed flat price for the scope you select. For assessed services (e.g. plumbing, electrical, handyman, A/C) the price shown is an estimate only: the Pro reviews your details and confirms the final binding price for your scope before the booking is confirmed, and you must expressly accept that final price — it is not re-priced on arrival.
- Your request is sent to available Pros. Pros indicate availability at the stated price; you choose which Pro to book. Pros do not bid different prices.
- Once you select a Pro and confirm the fee terms (Section 5), the booking is confirmed at the agreed price.
4. Prices and payment
- Cash on completion is the default. You pay the Pro directly, in cash, when the job is complete and you are satisfied. Nothing is collected at booking, and Fixyan does not hold your payment in escrow.
- Card and digital-wallet payment (e.g. bank card via ArCa, IDram, Telcell, EasyPay) may be offered. Card payments are processed by a licensed third-party payment provider; Fixyan does not store your full card details.
- The price shown for a flat-rate service is the guaranteed total for the selected scope. Additional work outside the agreed scope may be quoted separately and requires your agreement before it is performed.
Fiscal receipts. For cash-on-completion services the Pro acts as the seller of the service and is obligated under Article 380 of the Tax Code of the Republic of Armenia to provide you with a fiscal cash-register (HDM) receipt for the cash payment. Fixyan does not handle cash and does not issue fiscal receipts for cash payments. For card and digital-wallet payments made through the app, Fixyan operates an electronic cash register and issues you an electronic fiscal receipt (e-HDM), shown on your booking screen in the app.
5. Cancellations, rescheduling and refunds
- You may cancel or reschedule up to 24 hours before the scheduled start at no charge.
- Late cancellation (less than 24 hours before the start) incurs a Late Cancellation Fee of 20% of the job price. Pursuant to the Civil Code of the Republic of Armenia on the unilateral termination of service contracts, you may cancel a booking at any time; the fee compensates the Pro for reserved time, travel preparation and lost economic opportunity, and constitutes pre-agreed, reasonable liquidated damages.
- You explicitly accept this fee structure when confirming a booking — the booking screen requires your affirmative acknowledgment of the late cancellation and no-show fees before the booking can be placed, and the time of your acceptance is recorded.
- Because cash is paid only on completion, nothing is charged up front. An unpaid late-cancellation or no-show fee is recorded as a standing debt on your account, and Fixyan may suspend your ability to place new bookings until the debt is settled.
- Card payments: if you paid by card and cancel more than 24 hours before the start, the full amount is refunded; within 24 hours, the amount minus the Late Cancellation Fee is refunded. If a service paid by card is fundamentally defective or not delivered, contact support — refunds through the payment provider are facilitated by Fixyan acting on behalf of the Pro, who remains the responsible seller of the service.
- The displayed No-Show Policy governs missed visits and forms part of these Terms.
6. Your responsibilities
- Provide accurate booking details and safe, lawful access to the location.
- Treat Pros with respect; do not harass, discriminate against, or endanger them.
- Secure valuables and disclose hazards at the location.
- Do not arrange to take the transaction off-platform to avoid fees, and do not misuse the platform (fraud, false reviews, abusive content).
7. Pros are independent
Pros are independent service providers registered with the State Revenue Committee as Individual Entrepreneurs or Microbusinesses. They are engaged under civil-law contracts for the paid provision of services (Chapter 39 of the Civil Code of the Republic of Armenia) and are not employees, workers or agents of Fixyan. Fixyan does not control how a Pro performs the work, does not set their working hours, and does not guarantee any particular outcome. Fixyan vets Pros (including government-ID verification) for platform access.
8. Reviews and content
You may rate and review a completed job. Reviews must be honest and lawful. We may remove content that is unlawful, abusive, or fraudulent. You grant Fixyan a licence to display review content you submit within the platform.
9. Trust and safety
Fixyan provides identity verification of Pros ("Verified by ID") and in-app messaging so that scope-clarifying communication and photos stay within the platform. Report safety issues through the app. Fixyan does not provide insurance and makes no representation that services are insured or bonded; see the separate Insurance & Liability Disclaimer, which forms part of these Terms.
10. Limitation of liability
To the maximum extent permitted by the Civil Code of the Republic of Armenia and the Law on Protection of Consumers' Rights, Fixyan's liability is limited to the provision of the marketplace technology. Fixyan bears no vicarious or direct liability for property damage, theft, personal injury, or substandard performance caused by the independent Pros, whose statutory liability as the performing contractor is unaffected.
Nothing in these Terms excludes or limits Fixyan's liability for: (a) death or personal injury caused directly by Fixyan's own gross negligence; (b) intentional misconduct or fraud by Fixyan; or (c) any other liability that cannot lawfully be excluded under mandatory provisions of Armenian law.
In all permitted cases, Fixyan's total aggregate liability arising out of or relating to your use of the platform shall not exceed the greater of (i) the total platform fees paid by you in the six (6) months preceding the event giving rise to the claim, or (ii) 50,000 AMD.
11. Suspension and termination
We may suspend or terminate accounts that materially violate these Terms, the Community Guidelines, or applicable law. Enforcement decisions record the reason, and you may request a secondary administrative review by writing to support@fixyan.am within seven (7) calendar days of the notice.
You may stop using Fixyan at any time and may delete your account from within the app (Account & Security / Profile). Deletion permanently removes your profile and personal data as described in the Privacy Policy; records of financial transactions are retained for the statutory five-year period required by Armenian tax and accounting legislation, in anonymized form.
12. Changes to these Terms
We may update these Terms. We will notify you of material changes in the app, and continued use after changes take effect constitutes acceptance.
13. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of the Republic of Armenia. Any dispute, controversy or claim arising out of your use of the Fixyan platform shall be subject to the exclusive jurisdiction of the competent courts of Yerevan, Republic of Armenia. Nothing in these Terms deprives you of the protection granted by mandatory provisions of Armenian consumer-protection legislation, nor restricts your fundamental right to seek redress in the state courts.
